1. Acceptance of Terms

Welcome to Dylzapp. These Terms and Conditions ("Terms") govern your access to and use of the Dylzapp website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Service. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to these Terms.

2. Description of Service

Dylzapp is a location-based platform that enables:

  • Consumers to discover deals, promotions, discounts, and events from local businesses based on their geographic location
  • Business Owners to create, manage, and promote deals to attract local customers
  • Drivers (independent contractors) to list themselves in a public "Driver Directory," go live on the map for nearby riders, and arrange rides or deliveries peer-to-peer with those riders
  • Riders to discover nearby live drivers, message them directly, share pickup/dropoff locations, request trip quotes, exchange payment confirmations, and rate the driver after a settled trip
  • Users to send each other one-time-redeemable reward codes ("Peer Rewards") inside chat, and to optionally claim a business as an "affiliate" to earn a Verified-Affiliate badge on rewards they distribute

The Service includes features such as interactive maps, deal search and filtering, deal sharing, push notifications, payment processing for premium features, analytics for business owners, automatic business discovery via Google Places, business listing and claiming (including admin-initiated manual business creation for locations not indexed by Google Places), deal scheduling by day and time with server-side enforcement of scheduled availability windows, deal reminders with push notifications, proximity-based deal radar alerts, Uber/Lyft ride integration, community-driven business information updates, user-adjustable search radius (0.5 to 50 miles), time-based "Live Now" filtering, live coverage counts within your chosen radius, downloadable printable QR-code marketing posters for claimed businesses with associated scan-count analytics, a public per-business landing page showing currently-active deals with in-page prompts (including the Apple Smart App Banner and a dismissible install overlay) encouraging visitors to install the Dylzapp native app from their device's app store, and deep-linking into the native app via iOS Universal Links and Android App Links.

3. User Accounts

3.0 Eligibility

You must be at least 13 years old to use the Service. You must be at least 18 years old (and the age of legal majority in your jurisdiction) to register as or act as a Driver, to arrange, offer, request, or take any ride or delivery, to send or receive any payment, or to send, redeem, or claim any Peer Reward or affiliate business. By using any of these features you represent and warrant that you meet these age requirements and that all information you provide is truthful. Dylzapp may suspend or terminate any account it reasonably believes belongs to an underage user or contains false information.

3.1 Account Registration

To access certain features of the Service, you must create an account. You may register using your email address and password, through Google Sign-In, or through Apple Sign-In. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

Email verification. If you register with an email address and password, you must verify your email address before you can sign in. We send a verification link to the address you provide; you confirm that you own and control that address. Accounts created through Google or Apple Sign-In are verified by those providers. If you change the email address on your account, you must verify the new address (via a confirmation link sent to it) before the change takes effect; your previous address remains active until the new one is confirmed. Dylzapp may suspend or remove accounts that cannot be verified or that use an email address you do not control.

3.2 Account Termination

You may delete your account at any time through the Admin Dashboard settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful activities.

4. Consumer Terms

As a consumer using Dylzapp to discover deals:

  • You may browse deals without creating an account
  • You grant us permission to access your device's location to show nearby deals
  • You may save/bookmark deals for later viewing
  • You may upload a profile photo from your device to personalize your account. By uploading a photo you confirm you have the right to use the image and grant Dylzapp a non-exclusive, worldwide, royalty-free license to display the photo wherever your name appears on the platform (e.g. the public Cheap Gas leaderboard if you submit gas reports). You may replace or remove your photo at any time from your profile settings. Uploaded photos must not contain illegal, abusive, sexually explicit, or rights-infringing content and may be removed by Dylzapp at its discretion
  • You may participate in business surveys shared through deals
  • You may scan QR codes associated with deals for redemption or additional information
  • You may use the Deal Radar feature to receive proximity-based notifications when near active deals. The Deal Radar checks your location periodically (approximately every 2 minutes) when enabled
  • You may set deal reminders for future dates/times. Reminders trigger push notifications 15 minutes before and at the scheduled time. You can cancel reminders at any time
  • You may browse business listings auto-discovered from Google Places, view their operating hours, ratings, and contact information
  • You may use Uber/Lyft deep links provided on business detail pages. These redirect you to third-party ride-hailing apps. Dylzapp is not responsible for the ride service, pricing, or availability
  • You may use Ticketmaster/Live Nation deep links on event-type deals (concerts, shows). These redirect you to third-party ticketing platforms. Dylzapp may earn affiliate revenue from completed ticket purchases. Dylzapp is not responsible for ticket availability, pricing, refunds, or event delivery.
  • You may suggest updates or corrections to business information. Submitted suggestions are reviewed at our discretion
  • You may participate in the crowdsourced "Cheap Gas" feature by submitting current gas prices for stations near you. By submitting a report you represent that the prices you enter are accurate to the best of your knowledge at the time of submission. Submitting deliberately false, misleading, or stale prices may result in revocation of earned points, removal of your reports, suspension of your gas-reporting privileges, or account termination. Each accepted report awards points to your account ledger. Points are non-transferable, have no cash value, expire if your account is deleted, and may be revoked at Dylzapp's discretion in cases of suspected fraud or abuse. Your first name and profile photo are publicly displayed on the per-station "Last reported by …" credit and on the rolling 7-day Top Reporters leaderboard — see the Privacy Policy for what is and isn't shown. Dylzapp does not guarantee the accuracy of any user-submitted gas prices and is not responsible for actual prices you encounter at the station; you are responsible for verifying prices on the pump before purchasing fuel
  • You may adjust your search radius from 0.5 to 50 miles to personalize which deals and businesses you see. This preference is stored locally on your device and is not transmitted to Dylzapp servers
  • You may use the "Live Now" filter to view only deals that are currently active based on the time of day and day of week. Live Now status is a best-effort estimate derived from schedule data provided by business owners and may not reflect actual availability
  • You understand that business operating hours, "LIVE" status, and other Google-sourced data may not always be accurate or up-to-date. Dylzapp does not guarantee the accuracy of third-party data
  • You understand that deals are created and managed by third-party businesses, and Dylzapp is not responsible for the accuracy, validity, or fulfillment of any deal
  • You are responsible for verifying deal details, terms, and conditions with the business before redemption
  • Dylzapp does not guarantee the availability of any deal or the quality of products/services offered by businesses

5. Business Owner Terms

5.1 Deal Creation

As a business owner creating deals on Dylzapp, you agree to:

  • Provide accurate and truthful information about your business and deals
  • Honor all deals you publish for their stated duration
  • Clearly communicate any terms, conditions, or restrictions on your deals
  • Not post misleading, deceptive, or fraudulent deals
  • Only upload images, videos, and content that you own or have the right to use
  • Comply with all applicable laws and regulations, including consumer protection laws
  • When using social media import features, you confirm you have the right to use the imported content for deal creation
  • When using AI-assisted deal description generation, you are responsible for reviewing and ensuring the accuracy of generated content

5.2 Deal Content Guidelines

Deal content (including text, images, videos, QR codes, and survey questions) must not include:

  • Illegal products or services
  • Adult or sexually explicit content
  • Hate speech, discriminatory content, or harassment
  • Weapons, drugs, or controlled substances
  • Counterfeit or stolen goods
  • Content that infringes on intellectual property rights
  • False or misleading health claims

5.3 Deal Reach and Payments

Business owners receive a free 1-mile reach radius for deals. To extend reach beyond 1 mile, payment is required:

  • Pricing is based on the reach radius selected (miles)
  • Payments are processed securely through Stripe
  • All payments are final and non-refundable, except as required by law
  • Extended reach applies for the duration of the deal (maximum 1 month)
  • You cannot increase reach on an existing deal without making a new payment

Launch-period promotion (currently active): The "Feature This Deal" option, which places a deal in the rotating Featured Deals strip on the Map page, is temporarily offered free of charge to admin accounts during Dylzapp's initial launch period. Each feature activation lasts 30 days and may be toggled off at any time. Dylzapp reserves the right to end this promotion at any time with reasonable notice and re-enable the paid Stripe checkout for Featured Deals. Free featuring during the promotion creates no payment obligation but does not guarantee any particular placement, impressions, or business outcome.

Paid Featured Deal pricing (post-promotion / web only): When the launch promotion ends, Featured Deal slots are sold at $10 per day, up to 30 days per activation (a 1-day feature is $10; a 14-day feature is $140). Payment is collected via Stripe Checkout. Featured Deals appear in the top-3 carousel rotation per category on the Home feed and on the Map's featured rotation. Dylzapp reserves the right to adjust pricing with reasonable notice. Per Apple App Store guidelines, the paid Featured Deal flow is not available inside the iOS native app — admins on iOS must complete the purchase via the web at dylzapp.com.

Payment Allowlist (Comped Accounts): Dylzapp may, at its sole discretion, grant individual partner accounts comped (no-charge) access to Featured Deals and Extended Reach. Comped users see payment controls in all surfaces (including the iOS native app) and the Stripe checkout step is bypassed server-side — the deal is featured or its reach extended immediately at no cost. Comping is a discretionary courtesy that may be revoked at any time, does not create a contractual entitlement, and is logged in our payment ledger as a comped transaction for audit purposes.

5.3a QR Posters and Scan Analytics

Claimed businesses may download a letter-size printable QR-code marketing poster from the Edit Business page. The QR code deep-links to a public Dylzapp page displaying the business's currently-active deals.

  • QR posters are provided free of charge to claimed businesses for any lawful promotional use (in-store display, windows, menus, table tents, flyers, etc.)
  • You may reprint and distribute the poster as many times as you wish
  • You may not alter the QR code, remove Dylzapp branding, or use the poster in a manner that misrepresents Dylzapp's relationship with your business
  • You may not distribute the poster in locations or contexts that are illegal, defamatory, or harmful to third parties
  • Each scan of your poster is logged anonymously (timestamp, device type, hashed IP) and aggregated into scan-count analytics viewable only by you (the claimant) and Dylzapp administrators. See the Privacy Policy for details
  • Dylzapp makes no guarantee regarding the number of scans, customers, or revenue your poster will generate
  • If you transfer ownership of your business or give up your claim on Dylzapp, access to the scan analytics ends and any unused scan history may be retained by Dylzapp for aggregate platform analytics

5.4 Deal Expiration

Deals have a maximum duration of 1 month from creation. Expired deals can be reactivated with a reset to the free 1-mile reach tier.

5.5 Daily Deal Scheduling

Business owners may create deals with daily schedules, specifying different time windows and discount amounts for different days of the week. Scheduled deals are only displayed to consumers during their active time windows. Business owners are responsible for ensuring their scheduled deals are accurate and honored during the specified times.

5.6 Business Claiming

Business listings are automatically discovered from Google Places and displayed on the Dylzapp map. Business owners with admin accounts may claim their business through a verification process:

  • Only admin (business owner) accounts may claim a business
  • To confirm you are authorized to claim a business, the email address on your account must match the business's official website domain (for example, an @yourbusiness.com email for a business whose website is yourbusiness.com). Claims from email addresses that do not match the business's domain are declined
  • If a business has no website on file, automatic domain verification is not possible; you may contact Dylzapp at info@dylzapp.com from a business email address to request a claim
  • A verification code is sent to your matching business email address and must be entered within 15 minutes to complete the claim
  • Once claimed, no other user may claim the same business
  • Claiming a business does not transfer ownership of the Google Places listing — it only grants the ability to create deals for that business on Dylzapp
  • Dylzapp reserves the right to revoke a business claim if the claimant is found to not be the legitimate owner or authorized representative
  • Fraudulent business claims may result in account suspension or termination

5.7 AI-Assisted Deal Discovery and Auto-Publishing

Dylzapp uses AI tooling (Tavily Search + Anthropic Claude) to automatically discover and summarize publicly-available deal information about businesses on the platform. When this feature is used:

  • AI extracts a candidate deal — title, description, discount, schedule, source URL, and (when present) an event-specific image, event date, and Ticketmaster/Live Nation event URL — from publicly-accessible web pages
  • For most categories, the candidate is queued for administrator review and is not visible to consumers until an administrator approves it
  • For claimed entertainment and sports venues only (concerts, shows, sporting events), Dylzapp runs AI deal discovery automatically on a daily schedule and AUTO-PUBLISHES candidates that meet a strict confidence threshold (≥0.80), have a future event date, AND link to a verifiable Ticketmaster or Live Nation event page. Lower-confidence candidates are discarded, not published
  • Each auto-imported deal stores the source URL alongside it, allowing the deal to be audited back to its original source
  • AI-extracted text and images are sourced from public web pages and are not fabricated; however, Dylzapp does not guarantee the accuracy, completeness, currency, or fitness for purpose of AI-discovered deals. Consumers should verify all deal terms with the business before relying on them
  • If you are a business owner and you find an auto-imported deal that misrepresents your business, you may claim the business and edit or remove the deal, or contact Dylzapp at info@dylzapp.com to request takedown
  • Dylzapp may discontinue, throttle, or modify AI deal discovery at any time without notice, including when external service providers raise costs or change their terms

6. Driver Directory, In-App Messaging, Pickup Pass, Ratings & Peer Rewards

6.1 Driver Directory — Bulletin Board, Not a Transportation Network Company

Dylzapp is a bulletin board, not a transportation network company. Drivers listed in the Dylzapp Driver Directory are independent third parties. Dylzapp does not employ, contract with, dispatch, route, set fares for, insure, vet (beyond a baseline ID + selfie identity check), screen criminal history, screen vehicle safety, or process payments for any driver. Dylzapp does not act as a transportation broker, motor carrier, or transportation network company under any state or federal regulation, and no provision of these Terms shall be construed to create any such relationship.

  • To appear in the Driver Directory you must apply through the Driver Dashboard, upload a clear photo of a valid government-issued ID and a current selfie (both are required up front and must be uploaded before your application can be submitted — an application cannot be created without them), and provide accurate vehicle, pricing, and Venmo / Cash App information. You represent that all information is accurate and that the ID belongs to you
  • Your verification selfie is used as your rider-facing driver photo. It is shown to a rider once they request a service from you (start a chat), and — only if you enable the optional "Show my photo on the map pin" setting — on your public live map pin. Your government-issued ID photo is never shown to other users and is used by Dylzapp administrators only to confirm your identity
  • You represent and warrant that you hold all licenses, registrations, insurance (including any commercial coverage required by your state for paid rideshare or delivery activity), and authorizations required by applicable law to provide the services you advertise. Dylzapp does not verify any of these and is not responsible for your compliance
  • You are an independent third party. Dylzapp does not pay you, withhold taxes for you, provide you with workers' compensation, unemployment insurance, or any employee benefit, and does not direct the means, manner, time, or route of any ride or delivery you accept
  • You are solely responsible for tax reporting on any income you earn through arrangements initiated on Dylzapp
  • Dylzapp administrators may approve, reject, suspend, or permanently remove driver applications and profiles at any time and at sole discretion, including for suspected fraud, low rating averages, user reports, ID/selfie mismatch, vehicle misrepresentation, off-platform abuse, or any other reason
  • Approval to appear in the directory creates no employment, agency, partnership, joint-venture, or franchise relationship with Dylzapp and confers no exclusive territory or guaranteed volume of business

6.2 Payments Are Peer-to-Peer — Dylzapp Never Processes or Holds Funds

All payments between riders and drivers (and between users for peer rewards) happen directly between the parties via Venmo or Cash App deep links. Dylzapp does not act as a payment processor, money transmitter, escrow agent, custodian of funds, or merchant of record for any peer-to-peer transaction. Dylzapp does not see, transmit, hold, refund, chargeback, or otherwise touch the money that flows between you and the other party. The "Pay via Venmo" and "Pay via Cash App" buttons inside the chat are deep links that hand you off to those third-party apps; your use of those apps is governed by the respective terms of service of Venmo (PayPal, Inc.) and Cash App (Block, Inc.).

  • The "I've paid" / "Payment received" buttons in the chat record an unverified, self-reported claim by the relevant party — they are not a financial settlement and Dylzapp does not verify the underlying transaction
  • The "Paid Verified" driver badge (awarded after 3 distinct riders have tapped "Payment received") is a community-trust signal only and is not a guarantee that any specific transaction occurred, succeeded, or was authorized by the rider
  • Disputes about whether a payment was sent, received, or owed are between the parties and Venmo / Cash App. Dylzapp will not mediate, refund, or reverse any peer-to-peer transaction
  • You agree not to send anyone payment information through the in-app chat that you would not want a Dylzapp administrator to see during a safety or abuse review

6.2a Driver & Fleet Subscriptions (Platform Access Fee)

Separate from the peer-to-peer payments above, Dylzapp charges a platform access subscription for appearing as a live, listed driver. This fee is paid to Dylzapp (not to any rider) for access to the Driver Directory and live-map listing — it is not a fare, commission, or a percentage of any ride/delivery, and Dylzapp still never touches the money between riders and drivers.

  • Driver subscription: $9.99 per month. Newly approved drivers receive a 7-day free trial. An approved driver must have an active subscription (or trial, fleet coverage, or an administrator comp) to use "Go Live" and appear on the rider map; without one, the driver can still use the rest of the app but will not be listed.
  • Fleet (business) accounts: Any user may create a Fleet account and add their approved drivers via a join code, billed at $7.99 per driver seat per month. The fleet owner is responsible for the fleet's subscription; an active fleet subscription covers each member driver's listing.
  • Billing model: Subscriptions are sold as renewable 30-day access passes via Stripe Checkout. Charges are final and non-refundable except as required by law. Dylzapp may adjust pricing with reasonable notice.
  • Comped accounts & grandfathering: Dylzapp may, at its sole discretion, grant any driver or fleet comped (no-charge) access; comping is a discretionary courtesy, creates no contractual entitlement, and may be revoked at any time. Drivers already approved before subscriptions launched were granted comped access.
  • iOS: Per Apple App Store guidelines, subscription purchase controls are not available inside the iOS native app — subscribe or manage billing via the web at dylzapp.com or on Android.

6.2b Multi-Stop Delivery Runs & Proof of Delivery

A user (buyer or seller) may build a multi-stop delivery "run" — one pickup plus multiple destinations — and assign it to an approved delivery driver. Dylzapp calculates the total driving distance for the optimized route (via the Google Directions API) and shows an estimated price (base fare + distance × the driver's per-mile rate). As with all Dylz Rides activity, the estimate is informational and all payment moves OFF-platform; Dylzapp does not process the delivery payment.

  • Proof-of-delivery photos are required. The assigned driver must capture a photo at each stop to mark it delivered. By using this feature you agree these photos may be viewed by the run's creator, the assigned driver, and Dylzapp administrators for delivery confirmation and dispute review.
  • Acceptable photos only. Drivers must photograph only the delivered package and its drop-off location. Photographing people, the inside of homes/businesses, or anything beyond what is needed to confirm delivery is prohibited and may result in removal from the platform.
  • Accuracy of addresses. The run creator is responsible for the accuracy of the pickup and destination addresses and any recipient details they enter. Dylzapp is not liable for misdeliveries caused by incorrect information.
  • Estimates. Distance and price are estimates generated from mapping data and may differ from actual miles driven. The driver and creator are responsible for agreeing on the final amount.
  • Invoices & earnings summaries are informational only. Dylzapp can group a driver's completed runs into a weekly per-business invoice (and a personal earnings summary) that the driver may print and provide to the businesses they serve. These documents reflect quoted/confirmed amounts for the driver's own records and convenience — they are not official tax, accounting, or legal documents, Dylzapp does not guarantee their accuracy, and payment remains arranged directly between the driver and the business. Drivers are solely responsible for their own taxes and reporting.

6.3 In-App Messaging & Pickup Pass

The Dylzapp "Messages" feature lets you exchange direct messages with another user (most commonly a rider ↔ driver during a ride or delivery). By using the chat you agree that:

  • You will not use the chat for harassment, threats, sexually explicit content directed at non-consenting users, spam, scams, off-platform recruiting away from the bulletin-board model in violation of these Terms, or any unlawful purpose
  • You consent to the storage of your messages, shared location pins, trip quotes, payment-status confirmations, Pickup Passes, and peer-reward records, and to administrator review for safety / abuse / dispute purposes. You understand that conversations are automatically cleared from both participants' inboxes when a trip is marked complete, that the underlying messages are permanently deleted within 30 days of being archived (by a completed trip or by your manual deletion), and that a Trip History summary is retained in place of the chat. You may delete any conversation from your own inbox at any time
  • The "Pickup Pass" feature generates a short alphanumeric code intended for delivery handoff (the rider gives the same code at order time and the driver shows it at the store at pickup). Pickup Passes are a convenience signal only and are not a guarantee that the order exists, was paid for, or will be honored by the store
  • You will not generate Pickup Passes for orders you did not place, did not pay for, or do not have authority to receive on behalf of
  • Dylzapp may remove messages, revoke a Pickup Pass, terminate a conversation, or suspend an account that violates this section

6.4 Background Geolocation (Approved Drivers, While "Live")

When an approved driver toggles "Go Live" in the Driver Dashboard, Dylzapp begins continuously collecting that driver's precise device location and refreshes their pin on the map roughly every 8–12 seconds. On native iOS and Android builds, the @capacitor-community/background-geolocation plugin keeps that location collection running while the Dylzapp app is backgrounded or the device screen is locked. By tapping "Go Live" you affirmatively consent to this continuous background collection for the duration of your live session. Tracking stops automatically when you tap "Go Offline," uninstall the app, sign out, or revoke the OS-level location permission. Dylzapp does not collect continuous background location from non-driver consumer accounts.

6.5 Driver Rating System

After a trip is "settled" (a chat in which the driver has tapped "Payment received"), both the rider and the driver may submit exactly one rating of the other party — a 1-to-5-star score plus an optional comment up to 280 characters. Ratings are aggregated into an average rating and total rating count that appear publicly on the rated user's map pin, chat header, and driver dashboard.

  • Comments are publicly visible but attributed using only the rater's first name and last initial (e.g. "Alex S.")
  • You may not rate yourself, rate the same trip twice, rate a thread that has not settled, write a comment that contains harassment, threats, sexually explicit content, doxxing, or content that violates a third party's rights, or coordinate with others to artificially inflate or sink another user's rating
  • You acknowledge that ratings cannot be edited or deleted by the rater once submitted (this prevents retroactive coercion of the rated party). If you believe a specific rating violates these Terms, contact info@dylzapp.com and an administrator will review
  • If a user's average rating falls below 3.5 stars after 5 or more ratings, that user is surfaced to an owner-only triage queue for human review. This is a flag, not an automatic suspension. Dylzapp may, at its sole discretion, take further action up to and including suspension or permanent removal from the Driver Directory, but is under no obligation to do so based solely on rating data
  • Ratings are a community-trust signal and are not a warranty or representation by Dylzapp about the quality, safety, or reliability of any user, driver, vehicle, or service

6.6 Peer-to-Peer Rewards & Affiliate-Business Claims

The Peer Rewards feature lets you send another user a one-time-redeemable code (a "reward") inside chat — for example, a coupon code you'd like to share. The Affiliate-Business Claims feature lets you claim a business as your "affiliate" so that rewards you've previously sent under that business name display a "Verified Affiliate" badge once an administrator approves your claim. By using either feature you agree that:

  • You have the right to share the code you send and you are not violating any agreement with the issuing business by distributing it
  • You will not use Peer Rewards to send malicious links, phishing payloads, illegal content, or anything prohibited by Section 7
  • Dylzapp does not hold any monetary value associated with a reward — redemption happens directly with the issuing business, and Dylzapp is not responsible for whether the business honors the code, what discount it actually delivers, or what conditions the business attaches
  • You may revoke a reward you sent at any time before the recipient redeems it; you may report any reward you receive that appears fraudulent or abusive
  • An affiliate-business claim does not transfer ownership of any business, does not establish an exclusive right to distribute rewards for that business on Dylzapp, and may be revoked by Dylzapp administrators at any time. The "Verified Affiliate" badge is a community-trust signal and not a representation that Dylzapp has independently audited your affiliate agreement with the business

6.7 Personal Safety, No Background Checks & Assumption of Risk

Dylzapp connects people for real-world interactions — rides, deliveries, and meetups at businesses (including via the "Dylz Ride" shortcut that opens the live-driver map from a deal or business). You interact with, get into vehicles with, hand items to, and transact with other users entirely at your own risk.

  • No screening. Dylzapp does NOT perform criminal background checks, driving-record checks, vehicle-safety inspections, insurance verification, or any vetting of any user beyond a baseline identity check (a government-ID photo + selfie) for drivers. A "Verified", "Paid Verified", star rating, or any other badge is a limited community-trust signal only — it is NOT a safety guarantee, endorsement, or representation by Dylzapp about any person's identity, character, fitness, criminal history, licensing, insurance, or the safety of any vehicle, ride, delivery, item, or meeting.
  • Your safety is your responsibility. We strongly encourage you to: confirm the other person's identity and vehicle (plate, make/model/color) before getting in or handing anything over; meet and transact in well-lit, public places; share your trip and the driver's details with someone you trust; trust your instincts and decline or end any interaction that feels unsafe; and never share account passwords or one-time login codes. In an emergency, contact local law enforcement (911 in the U.S.) — Dylzapp is not an emergency service and cannot dispatch help, locate you, or intervene in any interaction.
  • Assumption of risk & release. To the maximum extent permitted by law, you assume all risk arising from your interactions and arrangements with other users, whether online or in person, and you release, waive, and hold harmless Dylzapp and its officers, directors, employees, agents, and affiliates from any and all claims, demands, damages, injuries, losses, or liabilities — including bodily injury, death, property damage, theft, fraud, assault, harassment, or any economic loss — arising out of or in any way connected with the acts or omissions of other users, any ride, delivery, payment, meetup, or transaction arranged through the Service, or any content posted by another user. Dylzapp is not a party to, and bears no responsibility for, any agreement or transaction between users.
  • Reporting & blocking. If another user behaves abusively, fraudulently, or dangerously, stop the interaction and report it to info@dylzapp.com. Dylzapp may — but is under no obligation to — investigate, remove content, suspend, or permanently ban any user at its sole discretion. Reporting a user, or Dylzapp's review of any report, does not create any duty of care owed to you by Dylzapp.

7. Intellectual Property

7.1 Dylzapp Content

The Service and its original content (excluding user-generated content), features, and functionality are owned by Dylzapp and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User Content

By posting content (including deals, images, videos, and text) on Dylzapp, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with the Service. You retain ownership of your content.

You represent and warrant that you own or have the necessary rights to the content you post, and that the content does not violate any third party's rights.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated scripts, bots, or scrapers to access the Service
  • Transmit viruses, malware, or other malicious code
  • Harass, abuse, or harm other users
  • Use the Driver Directory, in-app chat, location pins, or "Go Live" tracking to stalk, surveil, locate, intimidate, or otherwise harm any person
  • Misrepresent your identity, age, vehicle, licensing, or insurance, or impersonate a driver, rider, business, or Dylzapp staff
  • Solicit, accept, or request payment for a ride, delivery, reward, or deal you do not intend to provide or honor, or otherwise defraud another user
  • Collect, store, publish, or share another user's personal information (including phone numbers, addresses, photos, or payment details) without their consent, or "dox" any person
  • Solicit minors, or use the Service to facilitate any activity that is harmful to or exploits minors
  • Send phishing links, malware, or fraudulent reward/payment requests through chat or Peer Rewards
  • Manipulate or artificially inflate deal views or engagement metrics
  • Circumvent any payment requirements for premium features
  • Create fake deals or business accounts

9. Third-Party Services

The Service integrates with third-party services including:

  • Google Maps: For location services and mapping functionality
  • Google Sign-In: For authentication
  • Apple Sign-In: For authentication
  • Apple Push Notification service (APNs): For iOS push notifications
  • Firebase Cloud Messaging (FCM): For Android push notifications
  • Stripe: For payment processing
  • Venmo (PayPal, Inc.) and Cash App (Block, Inc.): Deep-link targets for peer-to-peer payments between riders and drivers, and for any other off-platform monetary settlement initiated through Dylzapp chat. Dylzapp does not process, hold, or transmit these funds — see Section 6.2
  • SendGrid: For email delivery
  • OpenAI: For AI-powered deal description generation and content assistance
  • Anthropic (Claude): For AI-powered automatic deal discovery and structured extraction of publicly-available deal data
  • Tavily: For real-time web search used as the source for AI deal discovery
  • Sentry: For automated crash and error reporting (anonymized; PII stripped before transmission — see Privacy Policy for details)
  • Google Business Profile: For importing business information (with explicit authorization)

Your use of these third-party services is subject to their respective terms of service and privacy policies. Dylzapp is not responsible for the practices of these third parties.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

DYLZAPP DOES NOT WARRANT THAT:

  • The Service will be uninterrupted, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any deals displayed on the Service will be honored by businesses
  • The quality of any products, services, or deals obtained through the Service will meet your expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYLZAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or data
  • Business interruption
  • Losses arising from deals not being honored by businesses
  • Losses arising from unauthorized access to your account
  • Any other losses related to your use of the Service

IN NO EVENT SHALL DYLZAPP'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO DYLZAPP IN THE PAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Dylzapp and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you post on the Service
  • Any deals you create as a business owner

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dylzapp regarding the use of the Service and supersede any prior agreements.
